Terms, Limitations, and Release of Liability

These terms, conditions, and limitations are subject to change without notice. This version supersedes all previous versions. The most current version is also available upon request by emailing  office@sitrepservices.com.


1. General Terms

SitRep Services interprets and reports subsurface data only as indicated by the equipment in use at the time of service. Environmental and site conditions — including soil composition, moisture, debris, interference, surface coverings, and nearby structures — may affect accuracy and results.

Ground Penetrating Radar (GPR) performance is dependent on target size, depth, and material composition. As a general guideline, a target located three feet below grade typically must be at least three inches in diameter to be reliably detected.

No locating technology is capable of detecting all subsurface features under all conditions.


2. Client Responsibilities

The client is responsible for ensuring that the work site is safe, accessible, and secure before, during, and after SitRep Services performs work.

The client assumes all responsibility for decisions regarding cutting, drilling, excavation, trenching, coring, or any other ground-disturbing activity. No markings, statements, or comments made by SitRep Services personnel — whether verbal or written — shall be construed as approval, direction, or authorization to proceed with excavation.

Mechanical excavation must be avoided within two (2) feet in any direction of any marked utility until the location and depth have been visually confirmed by the client. SitRep Services provides no warranty or recommendation regarding excavation methods or procedures.


3. Obstacles and Accessibility

Obstacles such as buildings, fences, pavement, equipment, stored materials, vehicles, landscaping, or recently disturbed soil may limit or prevent scanning in certain areas.

SitRep equipment generally cannot scan within approximately two (2) feet of physical obstructions. Areas blocked by obstructions are not guaranteed to be accurately located.

If obstructions are moved or removed after a locate is completed, the affected areas must be rescanned. SitRep Services is not responsible for missed utilities or features in any area that was inaccessible or obstructed during the original scan.


4. Liability for Utility Strikes, Damages, and Repair Costs

SitRep Services reports and marks subsurface features only as indicated by the available locating equipment at the time of service. Due to the inherent limitations of locating technologies, environmental conditions, and unknown site factors, no locate, mark, map, or report is guaranteed to be complete or accurate.

SitRep Services does not insure, warrant, or guarantee the presence, absence, location, depth, or condition of any utility, structure, or subsurface feature. The client assumes all risk associated with excavation, drilling, cutting, coring, boring, trenching, or any other ground-disturbing activity. 811 tickets are always required and are the responsibility of the client to request and manage. All marked utilities or anomalies must be spotted and confirmed by the client before mechanical excavation within 2 feet in any direction of any SitRep markings or indicators.

SitRep Services, LLC shall not be liable for utility strikes, service interruptions, property damage, loss of use, repair costs, or consequential damages, whether or not utilities were marked, mapped, or discussed.

If SitRep Services elects to review or investigate a reported strike or damage, such review does not imply or create any admission of liability. Any financial accommodation, credit, fee waiver, or contribution toward repairs — if offered — is voluntary and does not constitute acceptance of responsibility.

If a strike or damage occurs, the client must immediately:

  • Stop work

  • Notify SitRep Services including providing wide-angle and close-up photographs of the affected area

  • Site access for SitRep to review if they so choose

Failure to allow SitRep Services to inspect, evaluate, and document the condition and/or possible remedies eliminates any possibility of discretionary review or accommodation.


5. Communication and Reporting

Project managers will document limitations or concerns encountered during the locate in the summary report and may also communicate them verbally, by phone, or by text.

Deliverables typically include:

  • Surface markings (paint and/or flags)

  • A site walkthrough when client contact is present

  • A written summary report

  • Photographs of markings

Mapping services may be available if requested prior to job completion. Summary reports are typically delivered by email within one (1) business day.


6. Billing and Payment Terms

Rates are calculated per crew (technician or project manager). Multiple crews may be assigned as required. A minimum service charge applies.

Cancellations less than 24 hours from the scheduled service will incur the minimum charge. First time customers are required to pay onsite or with card-on-file.

Jobs under $750 must be paid at time of service. Jobs over $750 may be invoiced for repeat customers, with payment due within 30 days.

Late fees of 1.5% per month apply to past-due balances.


7. Billing Disputes and Claim Deadlines

All invoices, reports, maps, and markings are deemed correct unless the client provides written notice of dispute within ten (10) calendar days of the service date or delivery of the summary report, whichever is later.

Claims related to Accuracy of markings, Missed utilities, Mapping, Site conditions, Scope of work, Equipment limitations must be submitted in writing within this ten-day period.

Failure to submit a timely written dispute constitutes full acceptance of the services and charges. Late disputes, offsets, or back-charges will not be recognized.


8. Liens and Collection Remedies

SitRep Services may pursue all lawful collection remedies, including mechanics and materialmen’s liens, bond claims, collections, and legal action where permitted by law.

When SitRep Services is hired by a contractor or subcontractor, nonpayment may result in claims or liens being filed against the customer or property or project where services were performed, as provided by Georgia law.

All remedies are cumulative and may be exercised independently or together.


9. Mapping and Data Deliverables

Maps and overlays are available in .KMZ and .PDF formats unless included in the quote. Sub-meter GPS is used; maps are not survey-grade and are approximate representations. Processing may require up to 24 hours before delivery of mapped findings.


10. Safety and Quality Assurance

SitRep Services is committed to safety and professional performance. Clients will be notified of any limitations or accuracy concerns. Additional visits or re-scans must be specifically requested.


11. Equipment Information

Equipment includes:

  • GSSI UtilityScan

  • GSSI StructureScan Mini XT

  • Radiodetection RD8100 / RD8200

  • Geode GPS Locator

Each system has inherent limitations and performance varies by site conditions.


12. Acceptance of Terms

By authorizing SitRep Services, the client acknowledges acceptance of these terms and releases SitRep Services, LLC and its affiliates from liability related to locating activities, including missed or inaccurately marked utilities.
